What types of claims can the Committee hear?

The Committee hears civil claims involving disputes over contracts, consumer matters, property damage, and debt recovery up to $500,000. Claims involving criminal matters, employment disputes, family law, or amounts exceeding $500,000 are outside the Committee's jurisdiction.

How do I know if my matter is eligible?

Review the eligibility criteria on our Resources page. Your matter must involve a civil dispute, fall within the $500,000 limit, not have been previously decided by a court, and be lodged within 3 years of the dispute arising. If you are unsure, contact our office and a case officer will assist you.

Do I need a lawyer to lodge a claim?

No. Legal representation is not required at any stage of the process. The Committee is designed to be accessible to all Australians regardless of their legal knowledge. Committee members are trained to assist self-represented parties and will ensure the process is fair for everyone.

How much does it cost to lodge a claim?

Accepted Answer

Lodging fees are assessed on a case-by-case basis and a quotation will be provided upon evaluation of your claim. There are no fees for the hearing or determination itself. In some circumstances, costs may be awarded against a party who has acted unreasonably — this is rare and will be explained in the determination.

Can I lodge a claim on behalf of someone else?

In limited circumstances, a person may lodge a claim on behalf of another — for example, a parent or guardian acting for a minor, or an authorised representative acting for a company. You must indicate this on the Claim Form and provide evidence of your authority to act.

How do I lodge a claim?

Download and complete Form CC-1 (Claim Form) from our Resources page. Attach all supporting documents — contracts, correspondence, receipts, and any prior communications. Submit your claim online via the portal, by post to our GPO Box, or in person at our office. You will receive an acknowledgement within 2 business days.

What documents should I attach to my claim?

Attach any documents that support your claim — written contracts or agreements, invoices and receipts, correspondence (emails, letters, text messages), photographs, and any prior attempts to resolve the dispute. The more clearly you document your claim, the smoother the process will be.

Can I lodge a claim online?

Yes. Claims can be submitted via our online portal, by post to our GPO Box, or in person at our office. All three methods are equally valid. If you submit by post, we recommend using registered mail so you have proof of delivery.

What happens after I lodge my claim?

You will receive an acknowledgement within 2 business days confirming your claim reference number. A case officer will then be assigned to review your claim for eligibility. If your claim is accepted, the other party will be formally notified and given an opportunity to respond.

Can I amend my claim after lodgement?

Minor amendments may be permitted before the matter is listed for hearing. You must apply in writing to the Committee explaining the nature of the amendment and the reason for it. Amendments that substantially change the nature of the claim may not be permitted.

Question 11

What happens at a hearing?

Both parties present their case before an independent committee member. You may present documents, call witnesses, and make submissions. The hearing is conducted in plain language — you do not need to use legal terminology. The committee member may ask questions of both parties to clarify the issues.

Can I attend the hearing by phone or video?

Yes. Hearings can be conducted in person, by telephone, or via video conference. If you wish to attend remotely, notify the Committee at least 5 business days before the hearing date so arrangements can be made.

Question 13

Can I bring a support person to the hearing?

Accepted Answer

Yes. You may bring a support person — such as a family member or friend — to the hearing. A support person may sit with you but may not speak on your behalf unless they are your authorised legal representative.

What if I cannot attend on the scheduled hearing date?

If you are unable to attend on the scheduled date, you must apply for an adjournment using Form CC-5 as soon as possible. Adjournments are granted only in exceptional circumstances. Failure to attend without an approved adjournment may result in the matter being decided in your absence.

How long does a hearing take?

Most hearings last between 1 and 3 hours depending on the complexity of the matter. You will be advised of the estimated duration when your hearing is scheduled. Complex matters involving multiple witnesses or extensive documents may take longer.

How long does it take to receive a determination?

Accepted Answer

A written determination is issued within 30 business days of the hearing. You will be notified by post and email when the determination is available. If the matter is particularly complex, the committee member may advise both parties that additional time is required.

Is the determination binding?

Yes. Determinations issued by the Committee are binding on both parties and are enforceable as a court order. If the other party fails to comply with the determination, you may take steps to enforce it through the relevant court.

Question 18

Can I appeal a determination?

Limited appeal rights exist. You may apply to the Committee for a review on the grounds of procedural error or jurisdictional error within 28 days of the determination. Appeals on the merits of the decision are not available. The determination letter will explain your appeal rights in full.

What if the other party does not comply with the determination?

If the respondent fails to comply with a determination, you may apply to the relevant court to enforce it as a court order. The Committee can provide guidance on the enforcement process. Contact our office for assistance.
